1 Introduction
These terms of use specify the terms and conditions governing your use of BabyBjörn AB’s ("BabyBjörn") website and any agreements you enter into with BabyBjörn via the website. The term, website, refers to all information provided on the website and other web pages belonging to BabyBjörn to which the website links, such as data files, written text, photographs, videos, other images and marketing material. 

BabyBjörn shall be entitled, at any time whatsoever and at its own discretion, to amend these terms and conditions without specific prior notification. Any amendments or new additions to these terms and conditions made by BabyBjörn will be made available by BabyBjörn on the website.  

By using this website, you consent to abide by these terms of use. If you do not accept these terms and conditions, you should not use the website. 

2 Contents, etc.
BabyBjörn aims to ensure that the content of and information provided on the website is both up-to-date and correct, but is unable to exclude the possibility that the website may contain certain inaccuracies. BabyBjörn accordingly discharges itself from liability for any written or printing errors and for any inaccurate information provided on the website. 

The prices shown on the website are only recommended prices. BabyBjörn does not sell any products itself: all sales to customers are made via retailers who are autonomous and independent of BabyBjörn. The retailers set their own prices and BabyBjörn is therefore unable to influence the actual price offered by the closest retailer. Prices may, therefore, differ from one retailer to another.

The retailers decide for themselves which products they will carry. BabyBjörn is, therefore, also unable to either influence or guarantee that the products presented on the website are actually sold by your closest retailer.

The website may include links to other web pages that do not belong to BabyBjörn and over which we have no control. We accept no responsibility for the privacy policy operated by these websites or their content and only provide the links in order to make it easier for our visitors to find more information in specific spheres.  

The website includes a directory containing contact details for BabyBjörn’s retailers. The retailers are autonomous and independent of BabyBjörn. The directory is provided as a service for you, the customer, to enable you to contact a retailer in your local area.  

4 Colours
We cannot guarantee that the colours shown on the website replicate exactly the colours of the products in reality. The way in which the colours are reproduced will depend on your computer settings. 

5 Confidentiality and personal data, etc.
BabyBjörn takes responsibility for all personal data, such as your name, address and date of birth, with which you provide us or which we acquire, e.g. in conjunction with a purchase, registration of purchased products, when you enter competitions or subscribe to newsletters. By providing us with your personal data, you consent to our using the information gathered to fulfil our undertakings to you and to provide the service that you expect. This may include delivering the goods you have ordered, carrying out credit checks, sending out information about BabyBjörn and other offerings for marketing purposes. If any problems arise when we are delivering goods to you or with products that you have purchased, we will use this data to contact you. The data will only be used within the corporate group and will not be passed on to any third party. BabyBjörn will monitor and handle your personal data in accordance with applicable personal data legislation. You may submit requests to view your personal data at kundservice@babybjorn.com

The website uses “cookies”. A cookie is a small text file that is sent from a website and then stored locally on the visitor’s hard disc. You can choose a setting on your web browser so that you receive a message before a website sends a cookie to your computer. You can then choose whether to accept or reject the cookie. You can also choose not to accept any cookies at all. If you choose not to accept any cookies, you can still visit our website, in which case you will have to choose a country every time you make a return visit to the site. Certain website functions may also not function as intended. We have chosen to use cookies partly in order to store information on the country choice you make the first time you visit the site. This means you avoid having to choose a country every time you visit us and also means that prices will be presented in your local currency. The cookie also allows us to know whether you have visited our website before and which of our pages you visited. We never use cookies to store personal information about – only to facilitate your visit to us and to enable us to monitor the number of visitors. 

6 Material that you upload or send to BabyBjörn in some other way
By sending material to BabyBjörn, e.g. written text, photographs, videos or other images, you grant BabyBjörn a non-exclusive and unlimited licence, either personally or through the agency of another party,  to use the material worldwide and in all technologies and media and in all forms. You also grant BabyBjörn the right to amend and edit the material so that it can be used in any manner that BabyBjörn deems appropriate. You can revoke this licence at any time by notifying BabyBjörn thereof. When you revoke the licence, BabyBjörn shall cease using the material at the earliest possible opportunity but no later than within six months of the revocation. BabyBjörn is, however, not liable to recall material already distributed.

You may only send material to BabyBjörn to which you hold the rights. By sending the material to BabyBjörn, you confirm that you have the right to licence BabyBjörn in the manner specified in the paragraph above, that BabyBjörn has no responsibility for the material you have sent, and that you will indemnify BabyBjörn and compensate BabyBjörn for any and all damage that BabyBjörn may suffer as a result of BabyBjörn’s use of the material, provided that BabyBjörn uses the material in accordance with the licence described above. 

7 Trademarks, copyright and other incorporeal rights
The trademarks, product names, other distinctive marks, patterns and domain names used on this website are the property of BabyBjörn, irrespective of whether they are registered or not.

The content of this website is protected under copyright law and is the property of BabyBjörn or licensed by BabyBjörn.

You may not download, save or use material from the website without the written consent of BabyBjörn or without it being explicitly stated on the website that the material may be downloaded and used in a specific way.  

8 Liability
BabyBjörn has no liability to you for any damage whatsoever, with the exception of cases in which the damage is covered by the company’s liability insurance and on condition that the insurer has, in the case in question, approved disbursement of funds. 

BabyBjörn shall never be liable for indirect damage, loss of income or other consequential damage. 

9 Force majeure
Force majeure postpones BabyBjörn’s fulfilment of its obligations. If the period during which force majeure obtains is longer than two months, both you and BabyBjörn shall be entitled to terminate the agreement without thereby giving rise to any obligation to pay damages.  

The term, force majeure, refers to, amongst other things, strikes, illness on the part of personnel, transport disruptions, import/export bans, irrespective of whether these conditions apply to the company or the company’s suppliers. 

These conditions are regulated by Swedish material rights legislation.
